What Happens if I am Found Guilty?

Obviously, this is the number one question every client has. What is going to happen to me? There are no easy or guaranteed answers. If an attorney guarantees you anything, I would look for another attorney. Generally, an attorney can give you an opinion based on the client’s background and the attorney’s experience in dealing with similar cases.

After a guilty finding, the judge gives the attorney an opportunity to speak on behalf of the client. This is called mitigation, defined as “to make less severe”.  This is a very important part of the process and can have a dramatic impact on the judge’s decision.

You should bring documentation of your employment, participation in alcohol classes, education, awards, military, and any other information that will reflect positively on your background. Letters of commendation and support are always welcome. As always, the effectiveness of this information in mitigation is subject to the facts of the case and the client’s criminal history and driving record.
