Dress appropriately. You should dress like you are preparing for a job interview. Suit or a coat and tie for the men. Conservative dress suit or dress slacks and a blouse for the women.
You must have someone drive you to the hearing. At the beginning of the hearing, you will be required to turn in your temporary license and any extension issued. If you receive an adverse ruling or the judge grants a restricted license, you will need someone to drive you from the hearing. If the ALJ grants a restricted license, you will need to have someone drive you to a full service MVA office to obtain the restricted license.
Proof of employment, enrollment in school and alcohol classes. In the event that you are seeking a restricted license for any of these activities, the regulations require proof of participation in these activities.
The ALJ is required to make a decision whether to grant a restricted license when a person is eligible. They balance your need for a driver’s license with the public safety of the citizens of Maryland. Accordingly, it is important to demonstrate your positive and appropriate response to these charges. A well prepared presentation by an experienced attorney, enrollment in an alcohol program, a positive letter from work, and a well dressed, contrite client can make a difference.
Unless your driving privileges are suspended without modification after the hearing, you will need to go to a full service MVA facility to obtain a driver’s license after the hearing. The type of license will depend on the outcome of the hearing. If the ALJ takes “no action”, the license will be the same as the one that was seized by the officer on the night of the arrest. If the license is restricted so that driving is limited for work or alcohol classes, a code will be placed on the driver’s license indicating such. The same hold true if the driver elects to participate in the ignition interlock program. However, you must first obtain the ignition interlock packet from the service provider prior to obtaining the license at the MVA. Regardless, you will be required to bring proper identification and money ($30.00) for the fee to the MVA to obtain your new driver’s license. There are two types of identification, primary and secondary identification. You are required to bring one of each. Examples of primary identification include your birth certificate, social security card and your passport. Secondary identification includes credit cards and a bill in your name to your current address.
